Is it legal or do I need a realtor in Canada?
While it is common practice to use a realtor in Canada, home-sellers are free to sell their house directly to a buyer. WCHB will use a lawyer, and we insist that all of our home-sellers use their own lawyers for the transaction as well.
What does it cost?
We charge no commission to you—the home-seller; we make our money when someone new buys the property.
Do I need to clean when I move out?
Each home is different, but we can work it into the deal so that you can leave items behind, leave things un-repaired, and we can even provide cleaning services. All of this is designed to help you sell for a minimal cost (just your moving expenses and legal fees).
What if I am behind on my mortgage payments or taxes?
You’re not alone! This is more common than you would imagine. We have the lawyers confirm all of the final dollar amounts owing and work that into the price we will pay for your property. Sometimes we can even help after foreclosure proceedings have been started.
Does the house need to “pass” inspection?
WCHB usually does a home inspection, but you will not be required to fix anything. We have buyers that are looking for homes in all kinds of shapes, sizes and conditions (even if you think it should be torn-down!).
How quickly can I get out?
This is entirely up to you, and we will work it into the deal. Most of our lawyers have many projects on-the-go, so it often depends on how quickly the legal team can get the information/documents they require, and if they have the staff to process the paperwork quickly.
What if I’m not ready yet?
We will provide an offer that is typically valid for 1 week. If you need more time, YOU own your house, YOU are in control. We sometimes have people call us back months later when they have decided the timing is better. We do encourage home-sellers to take action before their house goes into foreclosure—once the banks lawyers are involved, we may or may not be able to help you (each house/mortgage is different). If more than a week passes, we may also need to look at changes in the real estate market, and we may need to provide a slightly different offer.
What if it’s an estate home?
If a family member has passed away, we will need to see the probate documents. Getting probate can take 6-8 weeks, or it can be a very long process. We can speak with you, and even view the house and begin to talk about a deal at any time; however, the real estate cannot be sold until probate is approved by the courts.
What if I’m getting divorced and my soon-to-be-ex-partner is still on the title and the mortgage?
We may still be able to help. However, both partners must agree to the deal. Typically each partner would retain their own lawyer in this situation.
I don’t want other people to know why we’re moving.
Again this is more common than you might think. We keep your information private, and we don’t post any lawn signs until after you have moved out. It’s your business where you choose to live and why. Don’t worry, we’ve learned a lot about nosy neighbours over the years!
